public liability insurance claim?

Hi i would like some advice from anyone regarding a damage claim, I work for a telecommunications company, Im self employeed but i get work from a contract company who do installations of tv and digital systems, When you do a job for this contract company you are covered by there public liability insurance. I went to one address to install a tv system, during the install i had to drill an external wall so i checked the wall for pipes and electric with the provided detector it showed green which ment good to drill. So i drilled the wall but then water started coming out i had drilled in to a plastic water pipe which was undetectable by the provided detector from the comany. Now the contract company are charging me £500 for insurance excess.
What i need to know is can they charge me anything as this was not my fault as the water pipe was undetectable by the contract companys provided equiptment.

I think that this will boil down to the contractual conditions that you have with the telecommunications company. As a labour only sub-contractor I am surprised that the contract company do not ask you to carry your own public liability insurance.

The fact that the testing equipment didn’t work is probably not of to much relevance because it sounds like the pipe would not have been detected in any event.

A £500 excess for third party property damage is a bit on the heavy side, the normal excess tends to be £250. Maybe you could try this as a point of negotiation?
